Maintenance and Cure

If you have been injured as an offshore worker, regardless of whose fault your injury was, your employer is required by law to provide you with medical treatment and living expenses.  Known as maintenance and cure, these rights arose through general maritime law and are independent of the Jones Act.

Unseaworthiness

An injured maritime worker can also pursue a claim that the vessel on which he was injured was unseaworthy.  The warranty of seaworthiness is owed to the vessel’s crew by the operator of the vessel, and means that the vessel must be reasonably fit for its intended use.

The Jones Act

Maritime workers knowingly engage in extremely risky work, and the Jones Act provides such workers with protection against the negligence of an employer or any other employees or agents.  While other remedies can be brought against the owner of a vessel regardless of whether negligence caused the injury, the Jones Act specifically protects a seaman against the negligence of an employer or another employee.
